Washington, DC. January 19, 2023…Lawyers at Cherian LLP have announced that its client Team Worldwide Corp (TWW) obtained a complete dismissal with prejudice of patent infringement claims in the case and Coleman Co., The Coleman Company, Inc. v. Team Worldwide Corp., et al., Case No. 2:20-cv-00351-RCY-LRL in the Eastern District of Virginia.
U.S. District Judge Roderick C. Young (VA) issued an order saying that litigation has been dismissed after finding that “it (appeared) to the court that all matters of controversy in this action have been settled.”
Robert Harkins, of Cherian LLP, said his client, TWW, a defendant in the original case, had filed a counterclaim against Coleman, later adding Cheng-Chung Wang as another counterclaim plaintiff.
Claims by Coleman in the lawsuit involved a patent for a “double-height air mattress without the intermediate or central layer, allowing coils to extend between the top and bottom surface of the mattress.” Team Worldwide asserted that it did not infringe the patent claims and challenged the validity of the Coleman patent, as well as asserting its own patent infringement counterclaim.
According to an article in Law360, the decision from the court came after the companies involved filed a joint motion asking for dismissal of the case with prejudice.
