Marshall, TX. September 14, 2023…The law firm Cherian LLP announced that its client Bright Data Ltd. successfully stopped certain Oxylabs, UAB patent infringement claims from going to trial at this time, obtaining a stay regarding alleged infringement of two patents asserted by Oxylabs (previously known as Metacluster, UAB) at the pretrial conference held in the United States District Court in the Eastern District of Texas in the matter of Metacluster, UAB v Bright Data Ltd., Case No. 2:22-cv-00011-JRG-RSP.

On July 18, 2023, Cherian LLP successfully obtained findings from the Patent Trial Appeal Board that the asserted patent claims of U.S. Patent Nos. 9,503,498 and 9,516,091 owned by Oxylabs are likely invalid in a decision by the U.S. Patent Trial Appeal Board to institute Inter Partes Review of those patents. At the pretrial conference held on September 12, 2023 the Court stayed Oxylabs’ lawsuit regarding those patents.

The Cherian litigation team was led by Robert Harkins, who argued the stay motion, and includes Korula (Sunny) Cherian, Thomas Dunham, Ronald Wielkopolski, and Stephanie Wood. Cherian’s Patent Office proceedings team that obtained the Inter Partes Review decision was headed by Thomas Dunham and includes Robert Harkins, Elizabeth O’Brien and Robert Molitors.
